Contagious illnesses are a serious problem in hotels, restaurants, cruise ships, theme parks, schools, and other public places.  Bed bugs, carbon monoxide, and fires are similar issues.

This discussion is to learn about the duties of care of hospitality business operators and the liabilities that may be imposed by contract, negligence, statutes and regulations against the operators.

As attorneys for a guest who became ill with Legionella after staying at a hotel, what do you need to prove your case against the hotel?

Include at least one legal resource citation with your answer from LexisNexis or elsewhere. Include in the discussion how you would apply what you have learned from this assignment as a Manager.

How should hotels protect against contagious diseases? Find some case examples about the Spanish flu.
How should restaurants protect against foodborne illnesses such as e-coli? Find some case examples.
Find general information about Norovirus and explain why this disease is so difficult for hotels, restaurants and cruise ships to prevent and control. Some information is available at the Centers for Disease Control website. Find some case examples.
Read about the Reno Hilton Hotel case involving a Norovirus outbreak. What was the result of that case? What should restaurant owners learn from that case? The legal case is very short, but there are law journal articles and news articles about the case.

This case is about negligence, contracts and regulations.

I have adapted this hypothetical case from a real dispute.

A group of military pilots on leave took a vacation to the U.S. Virgin Islands.  They decided to go for a snorkel dive, though none of them were experienced divers.  They rented snorkel equipment from a dive shop on the hotel property where they were staying.  The hotel is next to a large marina.  The dive shop attendant had not been given any special training and had only limited experience herself with snorkeling.  The pilots asked her if the small island across the waterway would be a good place to go diving and she said, “Sure, people go there all the time.”  The pilots entered the water on a beach near the dive shop and began swimming toward the island.  On the way across, a 28-foot fishing boat, with only the boat driver aboard, did not see the swimmers and the boat’s propeller badly injured one of the pilots, causing serious injuries.  The other swimmers assisted the injured pilot back to the shore and began immediate first aid.  The dive shop attendant had no first aid supplies and was unable to offer any assistance other than to call for a rescue ambulance.  The injured pilot has permanent injuries and has sued the dive shop, the dive shop attendant personally, the hotel where the dive shop was located and the fishing boat captain.  Each pilot had signed a release of liability when renting the snorkel equipment, agreeing that they would not hold the dive shop liable for any injuries.  The injured pilot claims that each party breached its duty of care to him and that they failed to warn of the risks which they knew and failed to provide proper safety equipment.

Discuss potential liabilities by the dive shop and the hotel for injuries to the pilot.  Will the dive shop attendant be personally liable?  Find cases of negligence by a concession located on hotel property.

Discuss whether the Virgin Islands Marine Patrol may be liable for failing to post warning signs for swimmers about dangers of the boat channel. Find cases involving missing or displaced navigation markers.
Discuss whether the hotel’s marina may be liable for failing to post warning signs for swimmers about the dangers of the boat channel. Find cases involving the absence of warning signs for hazards near the hotel property.
Discuss whether the pilots who assisted their friend with first aid after the injury will have liability if their efforts actually caused greater injuries. Find a good samaritan case. Does it make a difference whether one was professionally trained in medical care?
Discuss how the case would be different if the injuries were caused by a shark in the water instead of a boat. Find a shark case
